Cozy Cadence — a brand of Celebrate Media
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Service.

2. Purchases
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase, including without limitation your payment details and billing address.
You represent and warrant that: (i) you have the legal right to use any payment method in connection with any Purchase; and (ii) the information you supply to us is true, correct, and complete.
We use Kartra as our third-party platform for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide your information to Kartra subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, an error in your order, or suspected fraud or an unauthorized transaction.

3. Product Delivery
Our products are digital goods delivered by internet download only. After your purchase has been approved, your order will be processed. Orders are typically processed within one (1) hour but could take as long as twenty-four (24) hours.
Once your order has been processed, you will receive a confirmation email with the information needed to access your download. This email serves as your electronic purchase receipt.
Downloads from our servers are monitored to ensure successful access. We reserve the right to terminate access to download servers in cases of abuse.

4. Refund Policy (Digital Goods)
Because our products are digital goods delivered via internet download and available for instant access, we do not offer refunds once a product has been accessed or downloaded, except where required by applicable law.
Where a specific product page states a different refund policy (for example, a 14-day money-back guarantee), that product-level policy applies.

5. EU Consumer Right of Withdrawal
If you are a consumer located in the European Union, you have the right to withdraw from a purchase within 14 days of the transaction date without giving any reason (the “Withdrawal Period”).
However, by completing your purchase and accessing a digital product immediately, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been made available to you.
This waiver is collected at the point of checkout. If you have not yet accessed or downloaded the product, you may exercise your right of withdrawal by contacting us at wendy@cozycadence.com within 14 days of purchase.
Nothing in these Terms affects your statutory rights as an EU consumer.

6. Subscription Products
The Tired Moms Club Membership
Subscription products are products for which customers pay a recurring monthly fee in exchange for continued access to the product or service. “Subscription products,” “memberships,” and “subscription services” all refer to the same type of product and are subject to the same policies.
Subscription fees are automatically charged on an ongoing monthly basis using the payment method provided at checkout.

Cancellation
Subscriptions may be cancelled at any point in time with no advance notice required.
When a subscription is cancelled, no additional fees will be charged. Cancellation takes effect at the end of the current billing cycle, and you will retain access to the membership for the remainder of that cycle.
If cancellation is requested fewer than 24 business hours before the next subscription fee is due, you may be charged for the following month’s subscription. Cancellation will then take effect at the end of that billing cycle.
Any cancellation requests made after a given month’s fee has been charged are not eligible for a refund. The membership will terminate at the end of that billing cycle and no future charges will apply.

Founding Member Pricing
Founding members who join at the promotional rate lock in that price for as long as they remain continuously subscribed. If a founding member cancels and later re-subscribes, the standard membership rate will apply.

7. Availability, Errors, and Inaccuracies
We are constantly updating our product and service offerings. Information found on the Service may contain errors or inaccuracies and may not always be complete or current. Products or services may be mispriced or described inaccurately.
We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

8. Accounts
When you create an account with us, you confirm that you are 18 years of age or older and that the information you provide is accurate, complete, and current. Inaccurate or incomplete information may result in immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

9. Intellectual Property
The Service and all of its original content, features, and functionality are and will remain the exclusive property of Celebrate Media / Cozy Cadence. All content is protected by copyright, trademark, and other applicable laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Celebrate Media.
Products purchased are for personal use only. You may not reproduce, share, resell, redistribute, or otherwise use our digital products for commercial purposes without prior written permission.

10. Links to Third-Party Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by Celebrate Media / Cozy Cadence. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

11. Disclaimer
The products and content offered through Cozy Cadence are for personal development and informational purposes only. They are not a substitute for professional mental health support, therapy, or medical advice. If you are experiencing a mental health crisis or require urgent support, please contact a qualified professional.
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

12. Limitation of Liability
To the fullest extent permitted by applicable law, Celebrate Media / Cozy Cadence and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of (or inability to access or use) the Service.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable Dutch or EU law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

13. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason, including a breach of these Terms.
If you wish to terminate your account, you may simply discontinue using the Service or contact us at wendy@cozycadence.com.

14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, without prejudice to your rights as an EU consumer under applicable mandatory consumer protection laws.

15. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a change is material, we will provide at least 30 days’ notice before the new terms take effect by posting a notice on our website or emailing registered users.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms.
